Uncertainty continued over the bail of DMK MP Kanimozhi and four others in the 2G spectrum case, with the Delhi High Court making it clear it was not bound by the Central Bureau of Investigation’s “concession” of not opposing the plea of the accused.
On a query by judge V K Shali, the CBI reaffirmed its stand of not opposing the grant of bail to Kanimozhi and others. “Is the judge bound by the CBI’s concession? The court is under obligation to assess all parameters against you,” the judge said, as the counsel of the accused contended the trial court had completely disregarded the CBI’s stand.
The judge issued notices to the CBI, seeking a formal reply by December 1, the next hearing. “We reiterate the stand taken before the trial court. There is no deviation from that,” Additional Solicitor General Mohan Parasaran said when judge Shali asked him if there was any change in the CBI’s stand.
DMK chief M Karunanidhi’s daughter Kanimozhi has been in Tihar Jail since her arrest on May 20. The other four — Kalaignar TV MD Sharad Kumar, Kusegaon Fruits and Vegetables Pvt Ltd directors Asif Balwa and Rajeev Agarwal and Bollywood producer Karim Morani — have moved the high court for bail.
